What Should I Do?
The first step in pursuing a medical malpractice case to is to talk to a qualified lawyer. Tell the lawyer exactly what happened to you, from the first time you visited your health care provider to the last time you had contact with him/her.
Also, gather all your medical records from all your health care providers and hospitals. They are required to provide you with copies if you request them (however, they may charge you copying costs).
Try to have answers to the following questions:
- What were the circumstances surrounding your illness or injury?
- How did your doctor treat it?
- What did your doctor tell you about your treatment?
- Did you follow your doctor’s instructions?
- What happened to you?
Answers to these and other relevant questions will become important if you decide to pursue a malpractice claim. Your lawyer will look at all this information and may have it reviewed by another medical professional.
If it is determined that you have a strong case, the next step is usually to give written notice of the claim to the individuals or entities that are believed to have committed the medical malpractice.
